Fatal assault inside Newport News bar followed argument between 2 men, court records show – Daily Press

A fatal assault at a bar and restaurant in Newport News on August 3 followed a verbal altercation between two men earlier that night, according to court documents.

Xavier Demonye Bonilla, 27, is accused of punching Justin Dudney twice in the head inside the Triple Effectz Ultra Lounge, knocking him unconscious.

Dudney suffered a severe hematoma and brainstem herniation, according to documents filed in Newport News District Court. On August 7, he was declared brain dead. He was later taken off life support and pronounced dead on August 10, and Bonilla was charged with intentional homicide.

Bonilla was arrested on the day of the attack on a charge of aggravated malicious wounds. The charges were upgraded after Dudney’s death.

The assault happened in the early morning hours of August 3 at the Triple Effectz Ultra Lounge, located in the 400 block of Denbigh Boulevard, according to Newport News police. Police were called to the stand for a report of an unconscious person at 1:41 a.m. Triple Effectz Ultra Lounge manager Ron Lewis declined to comment on the story as the matter is ongoing.

Surveillance footage from the nightclub showed Bonilla hitting Dudney twice, who then fell on his back as Bonilla left the establishment, according to court documents. Police found Dudney unresponsive on the ground with a head injury, according to a criminal complaint. Police recognized Bonilla in previous arrest history surveillance footage and took him into custody the same day, according to the complaint.

Bonilla’s left hand was swollen and he had superficial joint injuries when he was arrested, according to the complaint. The documents say he admitted to punching Dudney in the nightclub and the two had a previous verbal altercation earlier that night where he “let it slide”.

Bonilla told police that Dudney later approached him and said, “I’m going to the bathroom if you have something to get out of your chest, and no one can help you or save you.” him, according to documents.

A preliminary hearing on the assault charge is scheduled for September 27, but an attorney review hearing for the manslaughter charge is scheduled for August 31.
