Norfolk City Council considering revoking California Burrito permit

NORFOLK, Va. — The Norfolk City Council will consider revoking California Burrito’s conditional use license, which allows the business to operate as a nightclub that sells alcohol.

In the proposed revocation document, city officials cited several overcrowding violations between October 2020 and July 2022.

The restaurant’s permit covers hours of operation from 11 a.m. to 2 a.m. and caps total occupancy at 49 people, including employees. City officials described several instances where occupancy exceeded the limit, sometimes exceeding 100 people.

In May 2021, California Burrito owner and operator Miguel Roldan-Ortiz applied for a conditional use permit to operate as a nightclub, seeking to expand occupancy to 99 people.

Norfolk City Council denied it on March 8, following a recommendation from the city’s planning commission.

Norfolk’s zoning administrator sent the proposed revocation document to City Manager Chip Filer on Monday. Board members will decide whether to revoke California Burrito’s license at a public hearing on Oct. 11.

The move comes as authorities crack down on city center restaurants following multiple shootings and after Norfolk City Council passed new rules for would-be restaurant owners regarding liquor sales.

According to the rules, new restaurants will have to apply for a conditional use license if they want to sell alcohol to customers to drink in their establishment.

California Burrito is the latest Norfolk business to face license revocations, along with Scotty Quixx, Legacy Restaurant and Lounge and Culture Lounge & Restaurant.
